Every application names a responsible party — the individual who ultimately owns or controls the LLC:
- The responsible party must be an individual, not a company.
- The online application requires the responsible party to have a valid SSN or ITIN.
- Applicants without an SSN or ITIN — including non-resident founders — apply by fax or mail with Form SS-4 instead.
For non-US residents: Delaware is the most common formation state for non-resident founders, and the EIN is usually the critical piece of the puzzle (banks require it). The SS-4-by-fax route is the standard path, and authorized designees can act on the application.
